A special election would cost the district approximately $5,000, said Carroll. Trustee Arthur Lindquist asked what would happen if trustees didn't do anything about filling the vacancy.
"The board has an obligation to perform its duties," Carroll said. If it doesn't do anything, it would be "in violation of California law," he said. election is more representative than an ap pointment," Lindquist said. "I personally see no urgency in making an appointment." Carroll said he had "strong feelings" on the subject and that those who have applied or been nominated for the position should be interviewed by the trustees. If trustees refused to interview anyone after asking for candidates, they would be saying "we don't want you," Carroll said.
Kellogg said he had asked county counsel what would happen if the board did nothing. He said he was told that under the old law, the county board of education would make an appointment, but the new law said that the local board "shall" make an appointment or call for an election. There are two dangers in leaving the position vacant until November, Carroll said. One danger is that the trustees could deadlock on a 2- 2 vote. The other danger is that trustees could start voting for things they didn't honestly believe in to avoid deadlocking.
"Which one of the four of us in a deadlock is going to back down?" he asked. Carroll suggested that they interview the candidates May 6, vote by written ballot and then, if they fail to settle on an appointee, call for an election. Trustee Opal Skolnick agreed with Carroll's suggestion. Lindquist, however, objected, "This commits us to make an appointment if we agree." "That's the way it should be," Carroll said. Lindquist said Carroll was "getting the cart before the horse." Trustee Charles Ham asked Lindquist if he would rather interview the candidates and then decide whether to select one.
Lindquist said he favored not binding "ourselves to make an appointment." Ham said Carroll's idea was a good one, but if Lindquist had objections, they could interview the candidates and then decide whether to appoint one or call for an election. Skolnick said she thought the procedure should be spelled out more clearly. Ham said that if they decide to select a candidate, it would be done by written ballot. Trustees voted 4-0 to follow Ham's suggestion. Carroll said he has received about a half dozen letters and several phone calls on the appointment.
If anyone else is interested in the position, they could write him a letter. He said he would be contacting the candidates before next week's meeting so the candidates would have an opportunity to ask questions about the position.
